On Monday, a grand jury indicted a suspended Essex County detective for official misconduct for installing a GPS in a suspect’s car without a warrant, the attorney general said.

Timothy Kealy, 27, of Bloomfield was originally charged with obstructing the arrest and tampering with public records in the case, both of which are third-degree felonies.

Official misdemeanor is a felony of the second degree.
The Attorney General alleges that while Kealy was assigned to the Essex County Narcotics Task Force, he purchased, installed and connected a GPS tracker to a vehicle that belonged to a civilian suspect. He did not have the formal or legal authority to do so, the office says.
Generally, a supervisor should sign such an investigation step and then ask a judge to sign an appropriate court order.
The Essex District Attorney’s Internal Affairs Division began investigating Kealy in January 2020 and the Attorney General prosecuted him in July 2020.
Kealy remains suspended without pay, a spokesman for the prosecutor said Monday.
Patrick Toscano, Kealy’s attorney, said of the development: “You can load a radial tire. It doesn’t mean anything. In fact, it’s the defendant’s constitutional law.”
“However, the accusations in this case are absurd and absurd. Detective Kealy has been a phenomenal law enforcement officer for years. This obvious truth cannot be denied, ”Toscano said.
